Terms of Trade

  • These Terms of Trade apply to all work carried out by La Porta Electrical.
  • By accepting a quotation, booking work, or allowing work to commence, the client agrees to these Terms.

1. Quotations

  • Quotations are valid for fourteen (14) days unless otherwise stated and are based on visible and accessible conditions at the time of inspection.
  • Pricing may be adjusted where additional work is required due to hidden conditions, pre-existing faults, or circumstances not reasonably identifiable at the time of quoting.

2. Scope of Work and Variations

  • Work will be carried out as outlined in the quotation, and any changes or additions requested by the client will be treated as a variation.
  • Variations, including fault rectification or safety-related work, may be required to complete the work safely and compliantly.
  • Variations will always be discussed and approved before proceeding.

3. Fixed Pricing

  • La Porta Electrical provides clear upfront pricing before work begins.
  • No work will proceed without client approval.
  • If additional faults or safety issues are identified during the work, the client will be informed and provided with options before any further work proceeds.
  • Any additional work required will be treated as a variation and may incur additional charges.

4. Electrical Faults and Safety

  • Electrical work may identify pre-existing faults within the installation which can cause circuits or safety devices to trip or fail.
  • La Porta Electrical is not responsible for pre-existing faults.
  • Any fault finding or rectification required will be charged as additional work.

5. Safety Switch Installation

  • Installation of safety switches (RCDs/RCBOs) may identify pre-existing faults within the electrical installation.
  • These faults may cause the safety switch to trip immediately or intermittently after installation.
  • Any fault finding or rectification required will be charged as additional work.

6. Asbestos

  • The client must inform La Porta Electrical of any asbestos or hazardous materials present in the work area prior to commencement.
  • If asbestos is identified during the work, work will be stopped until it is made safe.
  • La Porta Electrical is not liable for any costs, delays, or damages arising from the presence of asbestos.

7. Access and Work Area Conditions

  • The client must provide safe, clear access and ensure the work area is free from hazards, obstructions, and pets.
  • The client must disclose relevant information including hazards or known electrical issues and obtain any required approvals.
  • Delays, restricted access, or unsafe conditions may result in additional charges.

8. Payment Terms

  • Payment is due upon completion of the work on the same day unless otherwise agreed in writing.
  • Ownership of supplied materials remains with La Porta Electrical until payment is received in full.

9. Late Payment and Recovery

  • Overdue amounts may incur interest at 10% per annum, calculated daily.
  • All costs associated with debt recovery, including legal and collection fees, may be charged to the client.
  • La Porta Electrical reserves the right to suspend work until outstanding amounts are paid.

10. Certificates of Compliance

  • Where required, a Certificate of Compliance or relevant electrical certification will be issued upon completion of the work.
  • Certificates will only be issued once full payment has been received.

11. Warranty

  • All workmanship is covered by a 5-year workmanship warranty from the date of completion.
  • Warranty does not cover misuse, wear and tear, work altered or repaired by others after completion, pre-existing faults, client-supplied materials, or storm damage, water damage, vermin damage, or supply authority issues.
  • Manufacturer warranties are passed on to the client.
  • All work is carried out in accordance with Australian Standards and NSW regulations.

12. Liability

  • La Porta Electrical is not liable for pre-existing defects, client-supplied equipment failure, or events outside reasonable control.
  • Indirect or consequential loss is excluded to the extent permitted by law.
  • Liability is limited to the value of the work supplied.

13. Governing Law

  • These Terms are governed by the laws of New South Wales, Australia.
  • Any disputes will be subject to the jurisdiction of the courts of that State.
